Are you taking the right steps to protect your restaurant’s Intellectual Property? Restaurant Trademark lawsuits are more common than you think.

In early April 2022, MomoIP, LLC filed a lawsuit against Yuzu Kitchen, LLC in New York claiming that Yuzu has infringed on their Trademark for the term “Lucky Peach” MomoIP, LLC is the Holding Company for the Intellectual Property of the Momofuku Group. The Momofuku Group contends that they hold the trademark for Lucky Peach. In fact, Momofuku is Japanese for Lucky Peach.

Lawsuits like this are commonplace in the restaurant industry. As a trademark owner, it’s critical to take steps to protect your IP when you become aware of an infringement.

On the other side, intentionally or not, restaurant owners can find themselves entangled in litigation over trademark infringement. You may be advertising your newly created Meatloaf dish, Masterpiece Meatloaf, and not realize that there has been a Masterpiece Meatloaf in Georgia for the past 20 years. Your General Liability policy typically includes Advertising Injury coverage which will defend you from inadvertent Trademark Infringement claims as well as pay damages when necessary.
