Workers Compensation Restaurant Class Codes

One of the most common errors we find at Statement Insurance Agency on clients’ workers compensation policies is that they have employees that are misclassified. A misclassification can cost you hundreds or even thousands of dollars per year. Not every state uses the same codes but most states, including Nevada, use the NCCI codes discussed in this article. California and a few other states have created their own codes to add confusion and make themselves feel more special. 

Here are the most commonly applicable class codes in the Bar and Restaurant industry:

9082 – Restaurant: NOC

Code 9082 is called Restaurant: NOC or Restaurant: Not Otherwise Classified.  This is the catch all code for most restaurants unless another code more accurately describes your operations.  If you have wait staff, your restaurant most likely falls into this code.  It can include anything from a breakfast café to a fine dining steakhouse.

9083 – Restaurant: Fast Food

Code 9083 is pretty self explanatory. This is for Fast Food establishments.  For classification purposes, your restaurant is a “fast food” restaurant if you don’t have wait staff.  This code encompasses traditional fast food joints as well as doughnut shops, coffee shops, and any other business where customers order directly from the counter or Drive-Thru.

9084 – Bar/Tavern

Code 9084 is for bars and taverns.  Plenty of restaurants serve alcohol and a lot of bars serve food so how do you know the difference?  (If you can get a tattoo in the bathroom, it’s probably a bar.)  According to NCCI, a bar is an establishment that gets greater than 50% of its revenue from alcohol. This code also includes Nightclubs, Lounges, and other businesses that get the majority of their revenue from serving alcohol.

Aside from the codes mentioned above, there may be other codes that apply to your operations.  For example, Bakeries, Breweries, and Wineries all have their own code.  Sometimes certain employees can be put into a less expensive code.
